When you act in some role as part of the conspiracy, you are responsible for what your co-conspirators have done even if it was never something you agreed to nor did you bring about. Using New York terminology, an ADA probably would have tried to plead her out to go after the bigger fish, but if she turned him down then she ran the risk of being convicted for the same thing as everyone else even if she was sitting in the car and never fired a shot. |
