I wouldn’t say smoking gun because of his admitted hard partying past and the fact that he isn’t willing to go under oath. There are bigger reasons to question the credibility, namely the initial anonymity and the fact that this isn’t the first time Brett Kavanaugh has been nominated for a position so why not come forward then. From what I have seen, the reality is somewhere in the middle. In a drunken night might Kavanaugh have done something he would never have done sober and without full mental faculties, yes. It is not disqualifying in and of itself and may not be illegal depending on Maryland law on mens rea. That being said, when taken in combination with his demonstrated judicial philosophy it does raise questions about whether he should be approved for a lifetime appointment on the Supreme Court.
