Technically coming here illegally is a crime. The problem I have is that a child really is not capable of forming the mental state to knowingly commit the crime, let alone intentionally. If that is their only crime and they did not play a role in coming to United States I don’t want to punish them because they legitimately are victims. You really think a 3 year old is going to stop his/her parents from breaking the law? |
