But states are constrained in their ability to defy federal law. Ask The South during the civil rights era.

States were found to be in contravention of the Civil Rights Act of 1965. Also, in that case states were preventing citizens from doing certain things, like sit in the front of a bus.

So it's doubly different. States aren't preventing ordinary citizens from doing stuff (except for the dubious item about keeping businesses from talking to ICE without a subpoena - I would expect that one to fall). And secondly, there's no similar Act in the current situation that says that state employees must do x, y, and z.

But again, I'm not Justice Kennedy, so my opinion is only worth the electrons it's expressed with.
