If the cops track down and catch a criminal, and eyewitnesses say "he did. We saw it"; and his neighbors all say, "we've known he was a criminal for decades"; and his wife and kids say: "he told us he did it" -- do you still have to try him before sending him to the penitentiary?

And if Franken resigns? Under what pressure? With what threats? You know a contract made under duress can be nullified.
