But would the framers have extended that to children? Mentally ill? The latter has a history stretching over 3700 years indicating that that should be an exception. The death penalty when applied to a not mentally ill adult who received proper Due Process it is one thing, but if you take any one factor out does it still remain consistent with the Eighth Amendment? That is why I am saying that per se applications of ambiguous wording lead to legislating from the bench. |
