Carter, Clinton, and Obama all acted within the law. Trump did not:

- Banning US residents before supposedly rescinding that ban.

- Proposing a religious test for entry.

- Restricting entry based on national origin, without any regard to other circumstances (the government of Iran engaged in an act of war against the US; the government of Iraq has not).

- Banning people with valid visas.

Congress could authorize Trump to do everything he's done (except for the religious test), but they haven't.
