I presume that such a court only has jurisdiction to settle civil disputes voluntarily brought before it by the consent of both parties, and cannot make decisions that are contrary to Israeli law. So why does there need to be any government participation in the formation of such a court? Why wouldn't it just be treated like an independent association of arbitrators.

I realize Israel doesn't have separation of religion and state like the US, but I'm not seeing the value of government involvement.
