Terrorism usually requires intent because it's usually premeditated, which requires mental capacity. If he's determined to be sane, then the legal characteristics of terrorism probably will be met. But if he's found to be lacking mental capacity, that will be a tough charge to make stick.That's what I've been saying all along. The legal elements of domestic terrorism are quite specific, much more so than the colloquially used term everyone throws around. It's still too early to say what yet what he will be charged with (despite all the calls from everyone EXCEPT the police or FBI that it's domestic terrorism). |
