What about Eric Robert Rudolph? Supported by a church through his most horrific acts and the church did not face the slightest censure for their support of terrorism. If churches incite people to commit violent crimes, then they should be prosecuted for incitement. The Supreme Court has been inconsistent on where exactly the line falls here (compare the approaches in Dennis v United States and Brandenburg v Ohio), but realistically, if you preach a sermon saying that the American people are a brood of vipers (or whatever) and that it is your co-religionists' duty to kill them, then you are obviously complicit in their crimes. Evidence collection may be a more serious problem than the First Amendment in such cases though... |
