Actually, the recent trend has been away from any type of intent for a lot of things. The Democratic federal government likes strict liability crimes with doesn't offer an intent, or as italianstallion didn't know, mens rea.And as you said, like during Dubya, we have a precedent where we invent intent even if there is none. This can be easily proved if the doctors were in fact White, or even Indian, and especially if there was a Jew in the bunch. |
