That already does happen, at least by where I live. The sentencing guidelines do provide a lot of leeway and Judges are rarely chided for reasonable downward modifications. I have a civil case where a client was hit by a drunk driver (he survived but had collarbone and other injuries) and the Judge gave 1 year (plea deal was 1-3) because there was an ICE hold and since the guy will be deported the Judge did not want the taxpayers to pay longer than they needed to to incarcerate since he will be deported when his sentence is done
