There were a couple of circuits (like the D.C. Circuit) which were close and filling open seats would give nominees of Democratic presidents the majority. Although that does not necessarily give a majority on each panel, if there is rehearing en banc it means on issues that are essentially divided on political party, like PPACA or Abortion restrictions, the Democrats will have a majority |
