You are confusing the death penalty with the necessary use of deadly force. Death penalty is imposed for conviction of a capital crime or crimes. The use of deadly force by a police officer is justified when it is used to protect the officer from injury or to prevent imminent injury of innocent civilians by a violent criminal.
