The supremacy clause is not absolute and only applies if contrary state laws are preempted whether express or implied. In this case because ENDA has not been passed there is actually no law at the Federal level either way regarding discrimination based on sexual orientation except for what the Supreme Court has said regarding fundamental rights like marriage and sex so a law that extends protections to sexual orientation is technically not contrary to federal law
