He is ACCUSED of workplace violence (and many other things).

It's not some company where the boss just fires you because an employee is problematic.

In this case it's the employer TRYING him. He has to continue to be an employee in order to be tried and under American law, in this case only THAT employer can legally try him and nobody else.

If they administratively "fire" him (incompatibility with the Armed Forces, unsatisfactory performance, etc) itself a long process, he becomes a free man, not subject to civilian jurisdiction.

He can only wish the Army fired him. I doubt he'd appeal it.

Until a military jury determines beyond a reasonable doubt that he committed the acts that he is accused of, he continues to be a paid employee.

Furthermore, in the unlikely event that he were to be acquitted, he would not only get service-connected disability, but he could also sue the Army for damages for having military people shoot him.
