What qualifies for the death penalty these days?One commentator said (before the verdict) that an 8-man, 4-woman jury would never condemn a young woman. And I would argue that what really qualifies her for the death penalty in the public mind wasn't the facts of the case, depraved as they are, but its notoriety. It was a single, if depraved, murder. The very depravity of it, and her attitude after the fact, suggests that she might actually be criminally insane, in the classic sense. And who gets the death penalty these days, and for what crimes? Of the various terrorist acts carried out in this country since the WTC in 1993, I believe we have only had two executions actually carried out: One of the two perpetrators of the Oklahoma City bombing (168 completely innocent people dead) and the older perp of the serial killing spree in the DC area, if you count that as terrorism. Now, standing on its own, I would certainly argue that she merits death, but there's that old "proportionality" argument. |
