Simplistic analogy. Neither Verity nor Kempthorne were blocked by the Senate.

Verity was "threatened" to be filibustered by Republicans as not being conservative enough. In the end, he was approved by 84 votes.

Kempthorne was never seriously threatened by a fiflibuster and he was approved on a voice vote.
