With government agencies in NYS it is slightly different than private entities. First you need a "notice of claim", if you don't file one, you can be time barred from filing the lawsuit. |

But the discussion was about a proper defendant. Filing a notice of claim against the MTA is not adequate where the NYCTA is the owner of the bus causing the injury. |
