The same thing happened to me on Northern Bouelvard in Great Neck. The bus I was operating was headed east just p[past Jayson Avenue, going about 20mph. The idiot motorcyclist, who had a female on the rear seat riding with him, attempted to make a U-turn in front of the bus, hit the right front, and were knocked down. As they both lay on the ground next to the crushed motorcycle, the man bleeding from both ears and the girlfriend screaming at the top of her lungs, I just calmly secured the bus and called for assistance. Not my fault, of course. Anyone who challenges a bus or other large vehicle is almost certain to come out a loser..... |

I doubt they could have held this one as a preventable. The cyclist was parked at the curb, then suddenly started up and tried to beat the bus and U-turn in front of it. He felt he could perform this stupid maneuver, then suddenly turned right into the front right corner and was knocked down - how stupid can one be if you don't know what traffic is on the other side of the bus? Sorry to say I didn't feel any sympathy for him. It all happened within a matter of seconds and there was no way the bus could have been brought to a halt to avoid hitting him. Rated non-preventable. |

The Authority will say the B/O saw/heard the m/c start and the headlight on and SHOULD have anticipated an impromptu start and rapid acceleration and should have been slowing to yield whether or not the m/c did anything! the accident reviewer will smile a snake oil salesman smile and say "Better safe than sorry!"It's a brave new world in the mind of the accident reviewers. Almost EVERY right side accident is deemed preventable. Rated: Preventable. |

Two men on a motorcycle died Sunday night after colliding with a city bus in Queens , police said. The men, traveling east on 31st Ave. in Jackson Heights, attempted to zip by a Q47 bus turning right onto 73rd St. about 8:15 p.m., officials said. The victims crashed into the front right side of the bus at high speed and were taken to Elmhurst Hospital Center, where both died. One victim was 25. The age of the other man was not immediately known, cops said. The bus driver and two passengers were taken to Elmhurst Hospital with minor injuries, according to an MTA spokesperson. And if the motorcycle operator's lawyer gets his hand on the TA's version of the internal accident report, don't you think much more in a financial payout will be sought after by that lawyer? I wonder how many lawyers realize that there is such a document within the TA - one that, yes, tries to pin every accident on the driver? And that the TA paper might (probably usually) differ from or contradict the police report..... |

Disagree, angle is not alone enough to determine such... the position of the light, and the speed of the motorcyclist is critical. If the motorcyclist was indeed speeding the fault entirely lands on the motorcyclist not the BO and if the light was changing to red when the BO was making the turn once again the fault falls on the motorcyclists.Verdict - Unknown. |

MTA has NO designation of 'Unknown".The kangaroo court in the past has charged yours truly with a "Preventable" when I was t-boned by a guy that my witnesses said ran a red light. I was informed that I should have had my brakes covered entering the intersection at 2 a.m.! The cops asked the driver of the car what color the light was and he stated, for the record, "Blue." MTA will say the Bus Operator failed to yield to the fast approaching motorcycle, there by causing the accident! And they will say this nonsense with a straight face! And charge the B/O with a PREVENTABLE. STILL LOL@BANGING GAVELS! |

It's funny.... you have rules and federal laws of cars crossing or going around rail gates, but hardly no rules or laws for bus operators being protected by alot of stupid head motorists... and I'm being kind with my words. Drivers cut in front of buses, making U-turns in front of buses, reversing rapidly in front of buses ect. People will always think about themselves and try to beat large vehicles. I mean.... What's the hurry y'all? Allow extra time and don't rush. Motorcycles and other vehicles are replaceable. Lives are not! |

But charging their operators with an accident as "preventable", no matter how wrong the other driver is in reality, means the agency will automatically lose the inevitable lawsuit.
