But ultimately the same question remains: who should bear the cost of the harm caused by using one of those "improved" means of travel? Should it not be the person choosing to use an "improved" means of travel absorb the risk and liability that such means imposes on those who forgo such "improvements"? Why should the pedestrian--who has already ceded a good part of the highway upon which he or she could otherwise travel--have to take precautions made necessary only because of the choices other people have made as to their travel, and to take on additional cost as well?*slow clap* |
