If an agency is receiving FTA funding for its buses, it must follow the FTA "Best Practices" manual, which requires competitive bidding. The product specifications may not unduly restrict competition (i.e. no "buy New York"); passing the "Shaker Test" can be a requirement.

The award doesn't have to be low bid, but a "best value" evaluation must be conducted to justify why low bid wasn't selected.
