I was rear ended in Manhattan stopped at a red traffic light on 56th street about a month ago in a 1 year old Mini with full coverage struck by an SUV at low speeds. Although the damage was no where near the Escalade's, the driver admitted guilt on the accident report, in part because his license plate broke off after riding up my bumper into the tailgate which I pointed out the mounting bolt scratches in my bumper skin and handing the cop the plate. Although I filed a claim with my own insurance to start the repairs after waiting almost 4 days to hear from the drivers insurance company, my body shop received his check and I did not have to use mine. I'd guess he was 100% responsible due to admission on the report but I can't see how a parked car can not get fixed by the culprit's insurance who hits it assuming there is a accident report.
