The contract can be terminated by Veolia if they...a) fail or refuse to provide service b) violate County orders c) abandon the contract d) file for bankruptcy e) fail to pay debts f) violate a law with relation to the contract or service (DOT?) g) fail to indemnify parties indicated in the contract h) fail to correct rejected work i) their officials are convicted of a crime j) the TAC fails to approve service cuts/fare hikes k) the County breaks the contract. These are the ONLY reasons for which Veolia can terminate. The County can terminate for any reason they want upon 90 days notice. If Veolia doesn't fulfill its contract, they are to keep running buses at their own expense until the county finds another operator. Starting July 1 the county can assess liquidated damages/award incentives for OTP, missed runs, accidents, and paratransit customers per hour. The standard used will be the MTA's. (why do you think they tried so hard to improve paratransit passengers per hour?) ![]() |
