If a bus service does not transport passengers in interstate commerce, then states (and municipalities) can regulate. The problem is that if a company discontinues all of its service contrary to law, and has no assets, then it becomes very difficult to enforce (the 13th amendment makes it difficult to compel drivers to work a bus route if the company has no money with which to pay them). In this case, I believe that the no. 10 was the only bus route being operated by Trans Hudson Express, and if the company had no assets, and no one wanted to financially support the company, how could it continue, notwithstanding any legal "compulsion" to operate? |
