Cogan yesterday handed Christopher Sakowski his plea back after the former bus driver and auxiliary police officer maintained his innocence and claimed he was stressed over his mother's health when he copped to a federal count of downloading child pornography in December last year. The deal called for Sakowski, 35, to serve a sentence of five to 20 years in prison, three years of parole, and required him to register as a sex offender. Upon rescinding the plea, the judge set trial for Feb. 22. "I am pleased with the judge's decision," said Sakowski's attorney, Mario Gallucci. "It demonstrates that he considered my client's mental state at the time of the plea. Mr. Sakowski looks forward to his day in court." A spokesman for the U.S. attorney's office in the Eastern District of New York declined comment. Federal agents seized about 400 images and four video clips of kiddie porn on a laptop computer when they raided Sakowski's Ada Drive home in April 2008. Prosecutors charged Sakowski downloaded the smut between November 2006 and March 2008 from eight different "members-only" Web sites, paying between $80 and $100 for a 30-day membership to each site. Sakowski claimed that while he was downloading adult pornography from two known adult Web sites, closed zip files were sent to his computer along with the adult porn files he intended to download, Gallucci wrote in his motion to withdraw the plea. When Sakowski later attempted to open the zip files, he said he saw the kiddie porn but immediately closed it out without purchasing the files. |
